The land is situated on the eastern edge of the village of Castle Bytham and is accessed from St Martin's Lane. Castle Bytham lies in the South-West corner of the County of Lincolnshire and is situated 7.5 miles to the North of Stamford.
Accessed from a gated entrance at the end of St Martin's Lane. The land comprises three adjacent grass fields which can be grazed as a whole, or closed off, so as to provide three separate compartments. The fields are predominately stock proof fenced and bounded by Hawthorn hedges and wire fencing. Fresh water is provided via a drinking place at Glen Brook, which forms the South-West boundary.
The land is a mix of Grade 3 & Grade 4 as categorised by the Agricultural Land Classification of England & Wales. The soil type is from the Ragdale series, being described as "slowly permeable, seasonally waterlogged, clayey and fine loamy over clayey soils", as defined by the Soil Survey of England & Wales.
METHOD OF SALE
The land is offered for sale by Informal Tender with Vacant Possession upon completion. The vendors are prepared to consider joint bids from interested parties and will consider offers for individual fields. The deadline for Tenders is midday on Friday 14th June 2019.
BASIC PAYMENT SCHEME
Entitlements commensurate with the claimable area of the land are included in the sale. All of the land has been declared for the 2019 Basic Payment Scheme and the successful purchaser will be required to indemnify the claimant in respect of any claim or penalty arising out of any failure by the purchaser to comply with the cross compliance requirements for the remainder of the 2019 scheme year.
The land is not included within any agri-environmental schemes and is therefore sold free of any on-going management restrictions.
The low lying level area of grass in field 3933 is designated as a Scheduled Ancient Monument by Historic England (List Entry Number: 1014681) under the Ancient Monuments and Archaeological Areas Act 1979 as amended. Within the Designation this area is detailed as the Fish Ponds serving the former Castle Bytham Castle. The land has been farmed by the Vendors and their predecessors for 90 years and during this time, we understand there have not been any restrictions or conditions imposed upon their grazing or hay production by the relevant governing authority.
WAYLEAVES, EASEMENTS & RIGHTS OF WAY
The land is sold subject to and with the benefit of all rights, including existing Rights of Way, both public and private, light, support, drainage, water and other obligations, easements and wayleaves; whether referred to or not in these particulars. The land is crossed by a public footpath and has a bridleway on the Northern boundary. A mains public sewer runs underground adjacent to the Southern boundary.
The Vendors shall reserve out of the sale a Right of Way to access their retained land along the route shown coloured brown on the plan attached. In addition, neighbouring landowners have access rights over the land to their respective land holdings and it is for the buyer to make this own enquiries.
SPORTING AND MINERAL RIGHTS
All sporting and mineral rights are to be included within the sale insofar as they are owned.
There shall be no claim for tenant right and the purchaser will not be entitled to make any claim for dilapidations or other matters.
Early entry for the grazing of the sward growth or harvesting of the hay crop will be made available to the successful purchaser upon payment of a double deposit.
The successful purchaser shall be deemed to have full knowledge of all boundary responsibilities.
All of the land is subject to Drainage Rates, payable to the Environment Agency.
Guide prices provided are exclusive of VAT. In the event that the sale of the property, or any part or right attached to it becomes a chargeable supply for the purposes of VAT, such tax will be payable in addition.
